Driver (Dispatch Agent) Terms

Effective Date: 1 January 2026 · Version 1.0 · Applies To: Individual Drivers / Dispatch Agents registered under a Courier

These Driver Terms govern your access to and use of the Vyete Driver App as an individual dispatch agent performing deliveries on behalf of a registered Courier. They supplement the Vyete Terms of Service.

Warning

Your primary employment or contract relationship is with your Courier — not with Vyete. Vyete provides the technology platform through which Couriers dispatch deliveries and Drivers confirm assignments. Vyete is not your employer and does not set your compensation.


1. Eligibility

To be registered as a Driver on the Platform, you must:

  • Be at least 18 years of age.
  • Hold a valid driving or motorcycle licence appropriate for the vehicle class you operate.
  • Possess a valid national identity document, passport, or equivalent government-issued photo ID.
  • Have no convictions for violent offences, theft, fraud, or traffic offences involving death or serious injury in the preceding 5 years.
  • Be authorised to work in the country of operation.
  • Not be simultaneously registered as a Driver under more than one Courier account without written consent of both Couriers and Vyete.

1.1 Vehicle Requirements

You must not operate a vehicle on Platform deliveries without valid, current insurance.

2. Availability Status

Keep your availability status accurate at all times:

Setting yourself AVAILABLE when you cannot accept assignments, or failing to update your status after completing a delivery, degrades the platform experience and may result in restrictions.

3. Assignment Conduct

3.1 Accepting an Assignment

When you accept an assignment you commit to completing the delivery unless a legitimate obstacle arises. Repeated rejection without legitimate reason will be flagged to your Courier and may restrict your availability.

3.2 At Pickup

  • Arrive at the pickup location within the estimated arrival time.
  • Verify packages against the manifest displayed in the app.
  • Record Proof of Pickup (QR scan or photo).
  • Do not accept packages that appear damaged, leaking, or that you have reasonable grounds to believe contain illegal items. Report these to your Courier immediately.

3.3 During Delivery

  • Transport packages securely, protecting them from weather, damage, and loss.
  • Follow special-handling instructions (fragile, do not stack, temperature-sensitive).
  • Do not open packages unless instructed for verification purposes.
  • Do not operate any vehicle while using a handheld device. Use hands-free functionality only.
  • Do not drive under the influence of alcohol, drugs, or any impairing substance.

3.4 At Delivery

  • Deliver to the specified address. Do not redirect without authorisation.
  • Record Proof of Delivery (photo + GPS coordinates) — mark DELIVERED only when the package has been physically transferred to the recipient or left in an agreed safe place.

3.5 Failed Deliveries

If delivery cannot be completed: record the attempt with the outcome (NO_ONE_HOME, WRONG_ADDRESS, REFUSED), retain the package, and await dispatch instructions for the next attempt. After the maximum number of attempts (default 3), return the package per your Courier's instructions. Never abandon a package.

4. Location Data

GPS coordinates are collected only during an active, confirmed delivery assignment to provide tracking to the recipient and Merchant, calculate delivery distances, and verify Proof of Delivery. Location is not collected when you are OFFLINE or ON_BREAK. GPS logs are retained for 30 days and then deleted.

5. Professional Standards

You must at all times:

  • Treat Customers, Merchants, and Courier staff with respect and professionalism.
  • Protect Customer and Merchant personal data (names, addresses, phone numbers) strictly for delivery purposes. Delete any local records within 24 hours of completing the delivery.
  • Wear any uniform or identification required by your Courier.

5.1 Prohibited Conduct

You must not:

  • Tamper with, open, photograph the contents of, or steal any package.
  • Request tips, additional payments, or goods from Customers or Merchants.
  • Share Customer or Merchant contact details or addresses with any third party.
  • Misrepresent delivery outcomes in the app (marking a delivery complete when it was not).
  • Harass, threaten, follow, or engage in discriminatory conduct toward any Customer, Merchant, or member of the public.
  • Sub-contract or delegate an accepted assignment without your Courier's explicit authorisation.

Serious violations (theft, assault, fraudulent delivery records) will be reported to law-enforcement authorities.

6. Safety Rights

You have the right to:

  • Refuse a delivery if you have reasonable safety concerns about the destination or the package.
  • Report unsafe working conditions to your Courier and to Vyete via the Driver App safety button.
  • Not be penalised for refusing assignments that genuinely pose a safety risk.

In any emergency, contact local emergency services first.

7. Ratings and Disputes

Customers and Merchants may rate individual deliveries. You may view your rating in the Driver App. You must not solicit, demand, or incentivise Customers or Merchants to modify ratings. If you believe a rating results from fraud or dispute, request a review through the Driver App within 7 days of the rating.

8. Account Suspension

Vyete may suspend your Driver App access if you breach these Terms, your licence or insurance lapses, or evidence of theft, fraud, harassment, or other serious misconduct is received. Vyete will notify you and your Courier, except where immediate suspension is necessary to protect safety.

9. Relationship with Vyete

These Terms create a limited licence to use the Vyete Driver App as an operator of your Courier's delivery business. They do not create employment, agency, or joint-venture between you and Vyete.

10. Governing Law

These Driver Terms are governed by the laws of the Republic of Kenya. Disputes between you and Vyete shall be submitted to the courts of Nairobi, Kenya.
