Brand Intellectual Property Policy

This policy explains how Vyete protects brand intellectual property on the platform, the rights and obligations of registered brands, and the process for reporting infringement.


1. Overview

Vyete is committed to protecting the intellectual property ("IP") rights of brands registered on the platform. Counterfeiting, trademark infringement, and copyright abuse undermine consumer trust and harm legitimate brand owners. This policy sets out Vyete's approach and the tools available to brands.

2. Types of Intellectual Property Protected

Vyete's IP protection framework covers:

3. Brand IP Registration on Vyete

3.1 Trademark Registration

When you complete brand registration, provide:

  • Trademark registration numbers and jurisdiction(s).
  • Certified copies of trademark certificates where required.
  • List of product categories covered by the trademark.

Vyete uses this information to power its automated brand protection tools.

3.2 Updating IP Records

Keep your IP records current in Brand Dashboard → IP Registry. Updating records within 30 days of any registration, renewal, or lapse is mandatory. Lapsed registrations will be flagged and may affect brand protection enforcement.

4. Vyete's Brand Protection Tools

4.1 Automated Listing Monitoring

Vyete's platform continuously scans all listings for:

  • Unauthorised use of your registered trademarks in product titles, descriptions, or seller names.
  • Product imagery that closely resembles your brand's registered designs.
  • Listings that appear to sell products under your brand name from unverified shops.

Suspected violations are queued for brand review in Brand Dashboard → IP Alerts.

4.2 Proactive De-listing

Where Vyete's automated systems detect a high-confidence trademark infringement, the listing may be proactively de-listed pending brand review. Vyete will notify you within 24 hours.

4.3 Brand Content Protection

All product images and copy you upload are fingerprinted. If a third party (including unverified shops) uploads your content without authorisation, our systems flag the duplication for review.

5. Reporting IP Infringement

5.1 How to Submit a Report

Submit IP infringement reports via Brand Dashboard → IP Reports → New Report or email [email protected] with the following:

  • Your brand registration on Vyete.
  • URL(s) of the infringing listing(s).
  • Nature of the infringement (trademark, copyright, design, etc.).
  • Your IP registration details (trademark number, copyright ownership evidence).
  • A declaration that the report is made in good faith and that you are the rights holder or authorised agent.

5.2 Processing Timeline

5.3 Emergency De-listing

Where a listing poses an immediate safety risk or is causing substantial, quantifiable harm, request emergency de-listing at [email protected] marked URGENT. Vyete will act within 4 hours during business hours.

6. Counter-Notice Process

A shop or seller whose listing is removed following an IP report may file a counter-notice if they believe the removal was made in error. Counter-notice requirements:

  • Written statement of the counter-filer's good-faith belief.
  • Identification of the removed listing(s).
  • Relevant authorisation (e.g., brand distribution agreement, licence).
  • Consent to Vyete sharing the counter-notice with the brand.

Vyete will evaluate counter-notices within 10 business days. If valid, the listing may be reinstated.

7. Repeat Infringers

Vyete operates a repeat infringer policy. Shops or sellers that accrue three or more upheld IP violations within any 12-month rolling period will have their accounts permanently terminated. This policy complies with applicable safe harbour requirements.

8. Brand Misuse and Abuse

8.1 Misrepresentation by Authorised Parties

Where an authorised shop misuses your brand assets, Vyete will take enforcement action on receipt of your report, including:

  • Requiring the shop to remove or correct the non-compliant content.
  • Suspending the shop's brand authorisation.

8.2 False IP Reports

Filing false or bad-faith IP reports is a serious violation of platform policy. Brands found to have submitted false reports may face suspension of IP reporting privileges and liability to affected sellers.

9. Counterfeit Product Programme

Vyete maintains a dedicated anti-counterfeiting programme:

  • Rapid response unit: A dedicated team handles suspected counterfeit listings.
  • Coordination with authorities: Vyete cooperates with law enforcement and customs authorities in the investigation of counterfeit networks.
  • Physical inspection: Vyete may arrange physical inspection of goods suspected to be counterfeit prior to delivery.

Brands are encouraged to participate in the programme by training Vyete's trust-and-safety team on identifying genuine vs. counterfeit products.

10. Liability

Vyete acts as an intermediary and is not liable for IP infringements by third-party shops or users. However, Vyete will act expeditiously upon receipt of a valid infringement report in accordance with applicable law.
