Tour Operator Terms

These Tour Operator Terms ("Tour Terms") govern the relationship between Vyete Limited ("Vyete") and any business or individual ("Tour Operator", "you") that lists tours, experiences, or activity packages on the Vyete Platform. These Tour Terms supplement and are incorporated into the Vyete Terms of Service. In the event of conflict, these Tour Terms take precedence in matters specifically relating to tour and experience services.


1. Eligibility and Registration

1.1 Who May Register

A Tour Operator must:

  • Be a duly registered business entity or a licensed sole trader.
  • Hold a valid Tourism Regulatory Authority (TRA) licence (Republic of Kenya) or equivalent authority in the country of operation.
  • Hold any sector-specific permits required for listed activities (Kenya Wildlife Service permits for safari activities, maritime licences for boat excursions, aviation authority approval for aerial experiences, etc.).
  • Maintain adequate public-liability insurance at all times (minimum KES 5,000,000 coverage per incident).

1.2 Registration Process

  1. Apply through the Tour Operator Dashboard.
  2. Provide your business registration certificate, TRA licence number and expiry date, proof of public-liability insurance, contact details of the principal operating representative, and at least one published emergency contact number operational during all active tours.
  3. Vyete reviews the application within 10 business days and may request additional documentation.

1.3 Ongoing Eligibility

You must maintain all licences and insurance throughout your registration. Permit or licence lapses must be reported to Vyete within 48 hours. Vyete may suspend your listings pending re-verification.

2. Listing Obligations

2.1 Required Content

Each experience listing must include:

  • Title and category (safari, hiking, water sports, cultural, culinary, etc.).
  • Accurate description of the experience including duration, physical demands, and inclusions/exclusions.
  • Meeting point or pickup details (map pin required).
  • Minimum and maximum group size.
  • Age restrictions and fitness requirements.
  • Seasonal availability and blackout dates.
  • Languages in which the experience is conducted.
  • Equipment provided and equipment the Customer must bring.
  • Payment inclusions (meals, park fees, transport) clearly specified.
  • Cancellation and refund policy meeting the minimum standards in the Booking & Cancellation Policy.

2.2 Accuracy and Updates

You are solely responsible for the accuracy of all listing content. Where listings become inaccurate (price changes, permit updates, route changes), you must update them before accepting new bookings. Persistent listing inaccuracies are a policy violation subject to enforcement action.

2.3 Availability Management

Availability calendars must be kept up to date in real time. Accepting bookings for unavailable slots is a policy violation. Overbooking that results in Customer displacement is treated as a Tour Operator cancellation under these Terms.

3. Booking Confirmation and Conduct

You must confirm or decline each booking notification within 2 hours (or until tour departure, whichever is sooner). Confirmed bookings are added to your Dashboard. The Customer receives a booking confirmation with meeting-point information and your emergency contact.

4. Customer Data

For each confirmed booking you receive: Customer name, number of participants, emergency contact, and special requirements declared at booking (dietary, accessibility, medical). This data must be processed in accordance with the Data Processing Agreement and used only for delivering the booked experience. Delete Customer data within 30 days of the experience date.

5. Fees and Taxes

Vyete charges a platform commission deducted from each payout. You are responsible for your own VAT obligations. Vyete issues a tax invoice covering the Platform commission; you must issue a valid receipt or invoice to the Customer where required by law.

6. Reviews and Ratings

Customers may leave reviews and star ratings. You may post one public response per review. Review manipulation — including offering incentives for positive reviews, threatening Customers over negative reviews, or soliciting fake reviews — is prohibited under the Acceptable Use Policy.

Listings that fall below an average rating of 3.0 / 5.0 over any rolling 90-day period (with at least 5 reviews) will receive a performance warning. Continued operation below this threshold may result in listing suppression or account suspension.

7. Suspension and Termination

Vyete may suspend a listing immediately for safety violations, fraud, or regulatory non-compliance, and may permanently delist for severe violations. You may close your account through the Tour Operator Dashboard.

8. Governing Law

These Tour Terms are governed by the laws of the Republic of Kenya. Disputes shall be resolved in the courts of Nairobi, Kenya, except that disputes involving tourism licensing or wildlife conduct may be referred to the applicable regulatory authority.
